Barrio KusineroPh Food Products, trading as Barrio Kusinero (“Barrio Kusinero,” “we,” “us,” or “our”), is the personal information controller responsible for personal information collected through barriokusinero.com, our Shopify store, order processing, customer support, marketing, and related services.

This policy explains what we collect, why and how we process it, who may receive it, retention, and rights under Republic Act No. 10173, the Data Privacy Act of 2012, its rules, and other applicable Philippine laws.

1. PERSONAL INFORMATION WE COLLECT

Depending on your use of our services, we may collect identity and contact information; billing and delivery addresses; order, transaction, return and refund information; payment status; account information; customer communications; device, browser, IP address, cookie and usage information; and information reasonably required for fraud prevention and security.

Payments are processed by third-party providers. Barrio Kusinero does not ordinarily receive or store your complete payment-card number or security code. Please provide only accurate information necessary for your order or inquiry.

2. SOURCES OF PERSONAL INFORMATION

We may collect information directly from you; automatically through Shopify, cookies, analytics and similar technologies; from payment providers, couriers, fulfillment providers and fraud-prevention services involved in your transaction; and from third parties when permitted by law or authorized by you.

3. PURPOSES AND LEGAL BASES

We process information to fulfill orders, payments, deliveries, returns, replacements and refunds; communicate order and service notices; provide support; maintain tax, accounting and transaction records; prevent fraud and security incidents; improve our services; comply with legal obligations; establish or defend legal claims; and send marketing communications when consented to or otherwise permitted.

Legal bases may include performance of our contract with you, compliance with law, consent, protection of lawful rights and interests, and other grounds permitted by Philippine law. You may withdraw consent without affecting earlier lawful processing.

4. COOKIES AND ANALYTICS

Shopify and our website may use cookies and similar technologies to operate the store, remember preferences, maintain security, understand usage, and support analytics or advertising. Where required, choices may be managed through website privacy controls or browser settings. Disabling essential cookies may affect functionality.

5. DISCLOSURE OF PERSONAL INFORMATION

We may disclose information reasonably necessary to Shopify; payment processors and financial institutions; couriers, logistics and fulfillment providers; technology, security, analytics, email, customer-support and professional service providers; government agencies, regulators, courts or law enforcement when legally required; and a legitimate business successor or adviser subject to safeguards.

We do not sell personal information. Service providers may process information only for authorized purposes and are expected to apply appropriate safeguards.

6. SHOPIFY AND PAYMENT PROVIDERS

Shopify hosts our online store and may process information in countries where Shopify and its providers operate. Shopify’s Consumer Privacy Policy is available at https://www.shopify.com/legal/privacy/consumers. The privacy notice of the payment provider selected at checkout may also apply. Barrio Kusinero remains responsible for its own processing activities.

7. INTERNATIONAL TRANSFERS

When providers process information outside the Philippines, we take reasonable and appropriate steps to require protection consistent with the Data Privacy Act, applicable National Privacy Commission issuances, and contractual or other lawful safeguards.

8. RETENTION

We retain information only as long as reasonably necessary for its declared purpose and for tax, accounting, consumer-protection, fraud-prevention, dispute-resolution and other legal obligations. Transaction records are retained for periods required by Philippine law. Support and marketing records are kept only while needed unless longer retention is required for legal claims. Information no longer required is securely deleted, anonymized or disposed of.

9. SECURITY

We use reasonable organizational, physical and technical safeguards, including access limitations, reputable providers, and store and account security measures. No transmission or storage system is completely secure. Do not send passwords, complete card details, or unnecessary sensitive information through ordinary email or the Contact Us form.

10. YOUR DATA PRIVACY RIGHTS

Subject to Philippine law, you may have the rights to be informed; access information; object or withdraw consent; correct inaccurate information; request blocking, deletion or destruction when appropriate; data portability when applicable; indemnification for violations; and complaint before the National Privacy Commission.

We may reasonably verify identity and authority before acting on a request and will not discriminate against a person properly exercising privacy rights.

11. CHILDREN

Our store is intended for persons with legal capacity or appropriate parental or guardian consent. We do not knowingly collect children’s information for purposes inconsistent with law. A parent or guardian may contact us regarding a child’s information.

12. THIRD-PARTY LINKS

Third-party websites linked from our store apply their own privacy and security practices. Review their notices before providing information.
