TERMS AND CONDITIONS

Welcome to Barrio Kusinero. These Terms and Conditions (“Terms”) govern your access to and use of the Barrio Kusinero website, online store, products, and related services (collectively, the “Services”).

The Barrio Kusinero online store is operated by Barrio KusineroPh Food Products, a business registered in the Philippines under DTI Business Name Registration No. 8265832.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

By accessing our website, placing an order, or otherwise using our Services, you agree to these Terms together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies made available on our website.

Nothing in these Terms is intended to exclude, restrict, or waive any right or remedy available to consumers under applicable Philippine law.

1. ELIGIBILITY AND CUSTOMER INFORMATION

By placing an order through our website, you represent that you have the legal capacity to enter into the transaction or that you are acting with the appropriate consent or authority required by law.

You agree to provide accurate, current, and complete information when placing an order, creating an account, or communicating with us.

You are responsible for maintaining the confidentiality and security of your account credentials, if applicable, and for activity conducted through your account.

2. PRODUCTS AND PRODUCT INFORMATION

Barrio Kusinero sells food products, including our Smoked Sinamak Grill Sauce and other products that may be offered from time to time.

We make reasonable efforts to ensure that product descriptions, photographs, ingredients, sizes, quantities, prices, and other information displayed on our website are accurate.

Actual product appearance, color, packaging, or labeling may vary slightly from photographs displayed on a screen due to lighting, photography, device settings, packaging updates, or production variations.

We may modify, discontinue, or limit the availability of a product when reasonably necessary.

Nothing in this section limits a customer's rights when a product is defective, damaged, unsafe, incorrectly supplied, materially different from its description, or otherwise fails to conform to applicable law or the customer's order.

3. FOOD PRODUCTS AND ALLERGEN INFORMATION

Customers are responsible for reviewing available product information, including ingredient and allergen information, before consumption.

If you have food allergies, sensitivities, dietary restrictions, or other concerns regarding ingredients, please contact us before purchasing or consuming the product.

Product handling, storage, preparation, and consumption instructions appearing on the product label or packaging should be followed.

If a product arrives with damaged packaging, leakage, a broken or compromised seal, or other signs that its safety or quality may have been affected, please do not consume it and contact us promptly.

4. ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the products identified in the order.

We may decline or cancel an order when reasonably necessary, including in cases involving:

  • Product unavailability;

  • Incorrect pricing or product information;

  • Suspected fraudulent or unauthorized transactions;

  • Payment failure;

  • Delivery addresses outside available courier coverage;

  • Orders that cannot reasonably be fulfilled; or

  • Other legitimate business, legal, safety, or regulatory reasons.

If we cancel an order after payment has been successfully collected, any amount due to the customer will be refunded through the appropriate payment method, subject to applicable processing procedures.

Customers should carefully review product variants, quantities, shipping information, and contact information before submitting an order.

Order cancellation requests should be made as soon as possible. Cancellation may no longer be possible once an order has been packed, fulfilled, or handed over to the courier.

5. PRICES AND PAYMENT

All prices displayed on our website are stated in Philippine Pesos (PHP) unless otherwise indicated.

Product prices, promotions, and discounts may change from time to time. The applicable product price is generally the price displayed and confirmed when the customer places the order, subject to correction of genuine errors as permitted by applicable law.

Shipping charges and other applicable charges will be disclosed during checkout before the customer completes the transaction.

Payment must be made using the payment methods available at checkout.

Payment transactions may be processed by third-party payment providers. Their processing times, security procedures, and applicable terms may also apply to the payment transaction.

We will not knowingly charge customers fees that were not properly disclosed before completion of the transaction.

6. SHIPPING AND DELIVERY

Orders are shipped according to our Shipping Policy, which forms part of these Terms.

Customers are responsible for providing accurate and complete delivery information.

Delivery dates and transit times are estimates unless expressly stated otherwise. Delivery may be affected by courier operations, weather, natural disasters, transportation disruptions, government restrictions, holidays, incorrect delivery information, and other circumstances outside our reasonable control.

We will make reasonable efforts to properly prepare, package, and hand over orders to our courier partners.

The use of a third-party courier does not remove any responsibility or consumer remedy that Barrio Kusinero may have under applicable Philippine law.

If an order arrives damaged, incomplete, incorrect, or otherwise materially different from the order placed, please contact us promptly so that we can investigate and provide an appropriate remedy where applicable.

7. RETURNS, REFUNDS, REPLACEMENTS, AND CANCELLATIONS

Returns, refunds, replacements, and cancellations are governed by our Refund Policy, which forms part of these Terms.

Because we sell consumable food products, returns based solely on change of mind, personal taste preference, or an incorrectly selected flavor or quantity generally cannot be accepted when the correct product was supplied in good condition and as described.

This restriction does not apply where a customer is legally entitled to a refund, replacement, or other remedy because a product is defective, damaged, unsafe, incorrectly supplied, materially different from its description, or otherwise non-conforming.

Nothing in our Refund Policy or these Terms is intended to waive rights granted under the Consumer Act of the Philippines, the Internet Transactions Act of 2023, their applicable rules and regulations, or other applicable Philippine laws.

8. CUSTOMER COMPLAINTS AND DISPUTE RESOLUTION

We encourage customers to contact Barrio Kusinero first regarding concerns involving an order, payment, delivery, refund, replacement, product quality, or other transaction.

We will make reasonable efforts to investigate complaints and work toward a fair and appropriate resolution.

Nothing in these Terms prevents a customer from exercising any right to seek assistance, mediation, alternative dispute resolution, or other remedies through the Department of Trade and Industry (DTI), another appropriate government agency, or a court of competent jurisdiction, subject to applicable Philippine laws and procedures.

9. PROMOTIONS AND DISCOUNTS

From time to time, Barrio Kusinero may offer promotional discounts, bundles, vouchers, free-shipping offers, or other promotions.

Promotional offers may be subject to specific eligibility requirements, validity periods, product limitations, minimum purchase requirements, redemption limits, or other conditions disclosed with the promotion.

Unless otherwise stated, promotions cannot be exchanged for cash.

We reserve the right to correct or cancel a promotion in cases of genuine technical, typographical, pricing, or system errors, subject to applicable law.

10. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Barrio Kusinero name, branding, logos, product photographs, product descriptions, graphics, videos, website content, designs, and other original materials appearing on our website are owned by or licensed to Barrio KusineroPh Food Products.

These materials may be protected under the Intellectual Property Code of the Philippines and other applicable intellectual property laws.

You may use our website for lawful personal and non-commercial purposes.

You may not reproduce, distribute, sell, modify, publish, commercially exploit, or represent our protected materials as your own without prior authorization, except where such use is permitted by applicable law.

Third-party trademarks, names, software, content, and other intellectual property remain the property of their respective owners.

11. THIRD-PARTY SERVICES

Our Services may rely on third parties, including Shopify, payment providers, courier companies, social media services, analytics providers, and other service providers.

These third parties may have their own terms, privacy policies, and operating procedures.

Barrio Kusinero is responsible for its own obligations to customers under applicable Philippine law. The involvement of a third-party service provider does not waive consumer rights or remedies that cannot legally be waived.

12. RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify.

Shopify provides the technology and e-commerce infrastructure used to operate the store, but products purchased from Barrio Kusinero are sold by Barrio KusineroPh Food Products.

Your purchase contract for Barrio Kusinero products is therefore with Barrio KusineroPh Food Products and not with Shopify, except to the extent that Shopify separately provides a service directly to you under its own applicable terms.

13. PRIVACY AND PERSONAL INFORMATION

Personal information collected through our website and Services is handled in accordance with our Privacy Policy and applicable Philippine data privacy laws.

Our website is hosted using Shopify's services, and certain personal information may therefore be processed by Shopify and other service providers involved in providing our website, payments, fulfillment, communications, analytics, and other necessary services.

Please review our Privacy Policy for more information regarding the collection, use, disclosure, storage, and protection of personal information and how you may exercise applicable data privacy rights.

14. PROHIBITED USES

You may not use our website or Services:

16. WARRANTIES AND CONSUMER RIGHTS

Except for warranties or guarantees expressly provided by Barrio Kusinero and those required by applicable law, no additional warranty is created merely by information appearing on the website.

However, nothing in these Terms excludes, restricts, modifies, or waives warranties, consumer guarantees, remedies, or other rights that cannot legally be excluded under Philippine law.

Customers retain all applicable statutory rights concerning product safety, conformity, quality, refunds, replacements, and other remedies.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable Philippine law, Barrio Kusinero will not be responsible for indirect or consequential losses arising solely from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms is intended to eliminate or reduce our obligations relating to defective, unsafe, damaged, incorrectly supplied, or otherwise non-conforming products where applicable law provides the customer with a remedy.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or claims resulting from your unlawful use of our Services, your material violation of these Terms, or your infringement of another person's rights.

This provision does not require a consumer to indemnify Barrio Kusinero for losses resulting from Barrio Kusinero's own violation of law, negligence, wrongful conduct, or obligations to the consumer.

19. SEVERABILITY

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision will be applied to the maximum extent legally permissible or severed where necessary.

The remaining provisions will continue in effect.

20. NO WAIVER OF CONSUMER RIGHTS

No provision of these Terms, our Refund Policy, Shipping Policy, Privacy Policy, or another store policy should be interpreted as waiving or restricting a consumer right that cannot legally be waived.

If any provision of these Terms conflicts with a mandatory requirement of Philippine law, the applicable law will prevail.

21. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices, payment or delivery arrangements, or applicable legal and regulatory requirements.

The current version will be posted on our website together with its latest revision date.

Changes will apply prospectively as required by applicable law and will not remove rights that a customer has already acquired in connection with a completed transaction.

22. GOVERNING LAW

These Terms and transactions made through the Barrio Kusinero online store are governed by and construed in accordance with the laws of the Republic of the Philippines.

Any dispute will be handled in accordance with applicable Philippine laws and procedures, including applicable consumer protection and alternative dispute-resolution mechanisms.

Nothing in this provision prevents a consumer from filing a complaint or pursuing a remedy before the Department of Trade and Industry or another government agency or venue authorized under applicable Philippine law.
